1. Who You Are Buying From

This website and the App are owned and operated by JBM Buildcare Products, which is the seller of the goods listed on them. We are not a marketplace and do not sell on behalf of third-party sellers.

2. The Website and the App

In these terms, "the Site" means this website and our Android app together. The App is the website shown inside an Android app: it offers the same catalogue, accounts, orders and payments, and everything in these terms applies to it in the same way. Nothing you can do in the App is governed by different terms from the website.

• We grant you a personal, non-exclusive, non-transferable licence to install and use the App on your own Android device for your own purchases. You may not copy, modify, reverse-engineer, resell or redistribute it.
• Install the App only from a source we publish. We are not responsible for copies obtained from anywhere else, which may have been tampered with.
• Because the App shows the live website, the content, prices and features you see in it change whenever the website does. We may update, restrict or discontinue the App at any time, and the website will remain available.
• You are responsible for your own device, its operating system, internet connection and any charges from your mobile provider.

3. Eligibility and Your Account

• You must be at least 18 years old and capable of entering into a binding contract under the Indian Contract Act, 1872.
• You can create an account with your email address and a password, in which case we email you a one-time code to confirm the address, or by signing in with your Google account. There is one account per email address: an account created with Google and an account created with a password for the same email are the same account, and a Google-created account can add a password later using "Forgot password".
• You agree to give accurate, current and complete information when registering, and to keep it up to date.
• You are responsible for keeping your password confidential and for all activity under your account, and for the security of the Google account and the phone you use to sign in. Tell us at once if you suspect unauthorised use.
• We may suspend or close an account that we reasonably believe has been used fraudulently, unlawfully, or in breach of these terms.
• You may browse the catalogue without signing in, but you need an account to check out, and to see or cancel your orders.

4. Products and Product Information

We sell construction chemicals and allied building materials. We take care to describe products accurately, and each listing shows its net quantity, price and available pack sizes. Product images and videos are illustrative, and packaging or shade may vary slightly between production batches.

Some products are listed as available on enquiry, or with a price range rather than a single price. These cannot be bought through the cart: the price shown is a guide only, and we will quote you for the quantity and delivery location you need (see section 12). The availability shown for a product is our best current information and may change before you order.

Technical data sheets provided on this site state typical values obtained under controlled laboratory conditions. They are general guidance, not a specification or performance guarantee for your particular project. Coverage, setting time, working time and final strength vary with substrate, surface preparation, mix ratio, ambient temperature, humidity and workmanship, all of which are outside our control.

You are responsible for satisfying yourself that a product is suitable for your intended application, and we strongly recommend carrying out a trial on a small representative area before full use. Where a project is critical or unusual, contact our technical team before purchase.

5. Prices, Discounts, Taxes and Invoices

• All prices are shown in Indian Rupees (INR) and are inclusive of Goods and Services Tax at the applicable rate, unless a listing expressly states otherwise.
• Where a product is discounted, the listing shows the original price struck through beside the price you pay. The price shown for your basket at checkout is the price you are charged.
• The total shown at checkout is the amount you pay. If we ever charge for delivery, that charge will be shown before you confirm the order.
• An invoice showing the taxable value and the GST charged is made available for your order once it has been delivered, and can be downloaded from your order page.
• Prices and discounts may change at any time, but a change will never affect an order we have already accepted.
• If a product is listed at a manifestly incorrect price because of a technical or typographical error, we may cancel the order and refund you in full rather than supply at that price. We will tell you before doing so.

6. How a Contract Is Formed

Listing a product on the Site is an invitation to offer, not an offer. When you place an order you are making an offer to buy. A binding contract comes into existence only when we confirm the order and its payment status, at which point your order shows as Confirmed and we will send you an order confirmation.

We may decline an order before that point — for example if the item is out of stock, if we cannot deliver to your location, if we suspect fraud, or if there has been a pricing error. If we decline an order you have already paid for, we will refund you in full.

7. Payment

• Payments are made online and are processed by our payment partner, Razorpay, which offers the methods it supports at the time, such as UPI, cards and net banking. Your card, UPI or banking credentials are entered directly with Razorpay and never pass through our servers.
• An order is confirmed only when Razorpay reports the payment as successful. Until then it shows as Payment Pending, and we do not prepare or dispatch it.
• If a payment fails or you close the payment window, no contract is formed. You can try the payment again, or cancel the order. If money has left your account but your order is not confirmed, see the Refund & Cancellation Policy.
• For a bulk or project order, a different payment arrangement may apply if we have agreed it with you in writing.

8. Delivery

• We deliver to the address you provide. Please check it carefully — we are not responsible for a failed delivery caused by an incorrect or incomplete address.
• Delivery timelines given at checkout or afterwards are good-faith estimates and not guaranteed dates.
• Risk in the goods passes to you on delivery. Please inspect the consignment on arrival and record any visible damage or shortage with the carrier at that time.
• Cement-based and polymer products are perishable in the sense that they have a stated shelf life. Store them as directed on the pack and use them within that period.

9. Cancellation, Returns and Refunds

Cancellations, returns and refunds are governed by our Refund & Cancellation Policy, which forms part of these terms. In summary, you may cancel an order yourself before it is processed for dispatch, and defective, damaged or incorrectly supplied goods will be replaced or refunded.

10. Warranty and Its Limits

We warrant that our products conform to the specification stated on their packaging and technical data sheet at the time they leave our works, and that they are free from manufacturing defects. This is in addition to, and does not affect, the rights available to you as a consumer under the Consumer Protection Act, 2019.

Because application is outside our control, this warranty does not cover loss or damage arising from storage beyond the stated shelf life or outside the stated conditions, mixing with water or additives in proportions other than those specified, inadequate surface preparation or curing, application in unsuitable weather, use for a purpose the product was not designed for, or workmanship by others.

Any claim relating to product quality must be raised promptly, with the batch number, invoice details and photographs, and — where practicable — before the material is fully consumed, so that we can investigate meaningfully.

11. Limitation of Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded — including your statutory rights as a consumer.

Subject to that, our total liability arising out of or in connection with an order is limited to the amount you paid for the goods giving rise to the claim, and we are not liable for indirect or consequential loss, loss of profit, loss of contract, delay to a project, or the cost of removing or reinstating other materials. We provide the website and the App as they are and cannot promise that they will always be available or free of interruption, for example during maintenance or because of a fault with your device or connection.

12. Bulk and Project Quotes

A quote issued in response to a bulk enquiry, or for a product listed on enquiry, is valid for the period stated on it, and is subject to stock availability and to our written acceptance of your order. Quoted prices are specific to the quantities and delivery location described in the enquiry.

13. Reviews and Content You Submit

• You can review an order after it has been delivered. A review must be your own honest experience, and is shown publicly with your first name.
• By submitting a review or an enquiry you confirm it is yours to give, and you give us a non-exclusive, royalty-free licence to display and use a review on the Site and in our marketing of the products it concerns. You keep ownership of it.
• We may remove a review that breaks the rules in section 14, and are not obliged to publish every review we receive.

14. Acceptable Use

You agree not to:

• use the Site for any unlawful purpose, or in breach of the Information Technology Act, 2000 or rules made under it;
• attempt to gain unauthorised access to any part of the Site, other accounts, or our systems;
• scrape, copy, republish or resell any content, product data or technical data sheet without our written permission;
• publish a review that is false, defamatory, obscene, infringing, or paid for on behalf of someone else;
• interfere with the proper working of the Site, including by introducing malicious code, tampering with the App or placing an unreasonable load on our systems.

15. Intellectual Property

The "Dolphin" brand, our name and logo, product names, packaging, photographs, videos, technical data sheets, the App and the content of this website are our property or that of our licensors, and are protected by law. Nothing on the Site grants you any licence to use them except to view the Site and place an order, and to use the App as set out in section 2.

16. Privacy and Communications

Our Privacy Policy explains what personal data we collect, why, and what rights you have over it. It forms part of these terms.

By placing an order you agree that we will contact you about it by email and through notifications on the Site — for example confirmations, status updates, invoices and refunds — and by phone if there is a problem with delivery. Our team may also occasionally email you a reminder about items left in your cart, or ask you to review a delivered order. You can ask us to stop those two by replying to the email, as the Privacy Policy explains.

17. Events Outside Our Control

We are not liable for any failure or delay in performing our obligations caused by an event beyond our reasonable control, including natural disaster, flood, fire, epidemic, war, civil unrest, strike, transport disruption, failure of utilities or telecommunications, or an act of government. If such an event continues for a prolonged period, either of us may cancel the affected order and we will refund any amount you have paid for it.

18. Grievance Redressal

In accordance with the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020, complaints about any order, product or content on the Site may be addressed to:

We will acknowledge your complaint within 48 hours and resolve it within one month of receipt.

19. Governing Law and Jurisdiction

These terms are governed by the laws of India. Subject to your rights as a consumer to approach a consumer forum having jurisdiction where you reside or work, the courts at Pune, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or relating to these terms.

20. Changes to These Terms

We may amend these terms from time to time. The "last updated" date above shows when they last changed. The terms in force at the moment you place an order are the ones that apply to that order, so please review them each time you buy. Continuing to use the website or the App after a change means you accept it.
